The package acceptance agreements is made and entered into by the customer electronically registering ("Customer") for services related to the receipt of packages from commercial package and delivery companies on their behalf by "Need A U.S. Address" locations ("Center") under the terms set forth herein (collectively, the "Services").
The center will accept and if necessary sign for items addressed to the register customer delivered to the
center by commercial delivery companies. The customer understands that this agreement is for the acceptance
of packages only, and the center is not permitted and may refuse the delivery of delivery of mail from the
U.S. Postal Service unless has
(a) entered into a separate mailbox service agreement with the center and
(b) has completed U.S. postal form 1583 for delivery of mail to a commercial receiving agency.
The customer understands the deliveries must be addressed to their registered name and include their member number as issued to the customer at the time of registration.
The customer understands the center will not accept Collect on Delivery (COD) items or any item containing hazardous materials, illegal or prohibited items. And has the right to refuse such deliveries.
After accepting an item on a customer's behalf, Need A U.S. Address centers will notify the customer of arrival via the text number or email address provided by the customer at the time of registration. It is the customer responsibility to make sure information text and email information provides is accurate and up to date. Need A U.S. Address and it's centers will not be held responsible for notifications not received by the customer due to inaccurate contact information or inaccurate or missing information on the package delivery label.
The customer understands and agrees that the center will hold their items for the time specified in the individual center's depot profile. The customer understands that storage fees will apply if items are left at the location for longer than the time specified. Customer agrees it is their responsibility to contact Need a U.S. address or the applicable center if they determine a package may have arrived and notification of package arrival was not received.
The customer understands that any item left over 30 days may be considered abandoned and will be disposed in accordance with the center's policy with no refund or monetary sum due to the customer.
Customer agrees that Need A U.S. Address may terminate the customers membership for good cause at anytime by providing the customer with notice via email or text. Good cause shall include but is not limited to:
The customer agrees that the center has the right to refuse delivery of any items that is not in accordance with the individual centers package size or weight limits.
Customer understands that the customer is fully responsible for ensuring that the shipping and acceptance of any item does not violate and state, federal or international laws or any terms or conditions of the commercial delivery company. The center is obligated to report any such violation to the appropriate agency. Customer agrees to protect, indemnify, defend and hold harmless Need A U.S. Address, their respective affiliates, subsidiaries, parent corporations, officers, directors and employees from any and all losses, damages, expenses, claims, demands, liabilities, judgments, settlement amounts, fines, penalties, costs and causes of action of every type and character arising out of the customer or the shipper's failure to comply with this provision.
Customer agrees to protect, indemnify, defend and hold harmless Need A U.S. Address, their respective affiliates, subsidiaries, parent corporations, officers, directors and employees from any and all losses, damages, expenses, claims, demands, liabilities, judgments, settlement amounts, fines, penalties, costs and causes of action of every type and character arising out of or in connection with the services including without limitation any demands, claims and caused of action for personal injury or property damage arising out of the services, from failure of a delivery company to deliver to deliver on time or otherwise delivery any items, from damage to or loss of any item by any cause whatsoever.
This agreement and all customer information shall remain confidential, except that this agreement and customer information, including customer's name, address, phone number and email address may be disclosed to Need A U.S. Address, it's successor or related entities for purposes related to customer's use of the services, or upon written request of any law enforcement or other government agency when legally mandated.
Customer agrees that each Need A U.S. Address location is individually owned and operated and that Need A U.S. Address is not responsible for any acts or omissions of it's locations.
Customer agrees and understands that customer has the sole responsibility for any loss or damage to items for any reason whatsoever, including damage from criminal acts, and customer is solely responsible for obtaining any insurance coverage for items if a customer deems insurance coverage necessary or desirable. The center provides it's services "as is" and without expressed, implied or statutory warranties or representations as to the services , where allowable by law. In no event will the center or Need A U.S. Address be liable to the customer for any incidental, consequential, exemplary, indirect, special or punitive damages arising out of or in this agreement or it's termination, regardless of the for of action irrespective of whether the center or Need A U.S. Address has been advised of the possibility or any loss or damage.
Customer agrees that the total amount of liability of the center or Need A U.S. Address, if any, for any and all claims arising out of or related to this agreement or performance of the services hereunder shall not exceed $100.00 regardless of the nature of the claim.
Customer understands that by registering for the Need A U.S. Address service that they agree to the terms of this agreement.
